As far as I know, there's no tax for donating. And yeah you actually donate to keep the service (emulator) up and running.

Is your server a church or a philanthropic organization ? If not, you cant accept donations. You have to register your income and pay taxes. That's why almost all private servers are illegal. Not because of the files or NcSoft, but due to tax evasion. To accept donations you must be registered and approved from your country or whatever to do so.
